Terms and Conditions

 

Bookings

When making a booking the booking form must be completed and signed. The person signing should be the group's leader. He or she must be over 21 and authorised by all members of the group who are listed on the booking form, to accept the booking conditions on their behalf. All communication will be made with the leader of the group, who should duly pass on to the other group members any relevant information. Upon receipt of the completed booking form, confirmation of the booking will be sent to you in writing, please check carefully to ensure it is correct, if not please inform us immediately. Our home is booked solely for the use of those persons named on the booking form unless agreed in writing with us. Once we have sent confirmation to you, we have a binding contract.We retain the right to alter our terms and conditions/ policies without notification.

Payment Terms

Once your booking has been confirmed by a non-refundable deposit of $300 we will reserve the house for your dates.
The remaining rental balance will be due 10 weeks before your arrival.
If your arrival date is less than 10 weeks away, the full balance will be due as soon as your booking has been confirmed.
The $300 security deposit is payable 2 weeks prior to your arrival, this will be refunded in full as and when a satisfactory inspection of the property is completed, usually within 2 weeks of your departure.
Paypal fees on credit/debit cards will be charged at 4%.

Insurance

It is the hirer's responsibility to take out appropriate insurance to cover all aspects of the trip and to assure passports, visa's and other documents are in order.
We accept no responsibility if cancellation becomes necessary due to war or threat of war, riot, terrorist act, natural disaster or adverse weather conditions or any other matter out of our control or for closure or cancellation of any flights.

Occupancy

Maximum capacity is 14 persons. The renters must treat the property, it's furniture, fittings, utensils and other facilities with respect. Any loss or damage must be reported immediately to the Management Company. The group's leader is responsible for paying for losses, damage or breakages. The owners reserve the right to withhold any funds from the security deposit to pay for any loss or damage caused to the property or its contents by any member of the group.
Pets and animals are expressly forbidden from our villa without the consent and agreement of the owner
Additional fees for pets may apply. Dogs are expressly forbidden from swimming in the pool and any infringement of this will result in a $500
charge for cleaning the pool.
The villa is available for occupancy from 4pm on the day of arrival and must be vacated by 10.00am on date of departure.
An adult must accompany persons under the age of 18.
We will not be liable for any loss or injury resulting from the use of the property and pool/spa.

Trash

The trash is collected  weekly on a Thursday morning. Please place the trash bins on the pavement for trash collection on Thursday morning(or the evening before). Please note that if excessive trash is left for the Management Company to remove prior to the next guests arriving they will make a $45 charge.

Smoking

There is a no smoking policy inside the villa and garage, but guests may smoke around the pool and gardens.

Swimming Pool and Spa

Additional pool/spa heating can be requested at time of booking or direct with our management company subject to payment being made ,please note it can take in excess of 24 hours for the pool to reach temperature. Please understand that it is not possible to guarantee the temperature of the pool, which to some degree is dependant upon the local weather.

Barbecue

We have provided a gas barbecue for our guests enjoyment for a rental charge of $40. Please be careful when using the equipment and follow the instructions for use. The barbecue must be used outside the lanai area so that it complies with Florida law. Please clean up any spills straight away. The barbecue and surrounding area must be left in a clean and satisfactory condition. If the management company deem the grill and area are left dirty an extra cleaning charge will be made and deducted from your security deposit (min $70). Please leave a note for the management company if gas is getting low so we can purchase a refill.

Cancellation - By You

If any member of your group needs to cancel the booking we would ask that we be informed immediately in writing or email, duly countersigned by the group leader. Cancellation will be effective from the date it is received by us. Cancellations are subject to charges detailed below as a percentage of the total amount due dependent on the time you cancel.

More than 8 weeks = deposit only
8 weeks to 0 days = 100% of the rental charge
Note: For most reasons beyond your control cancellation will be covered by your travel insurance. But cancellation due to financial reasons or no longer wishing to travel is unlikely to be included in your travel insurance.

Cancellation - By Us

In the unlikely event that due to circumstances beyond our control, we need to make changes to or cancel your booking, we will inform you as soon as possible. We reserve the right to cancel any bookings at any time, and will only be held liable to refund Monies already paid by you the client. (Including the $300 security deposit).

Management

A local professional management company maintains the villa. They are responsible for the very high standards of cleanliness and care of the villa, pool and garden areas. They can be contacted at any time to help make your holiday problem free.

Website and Brochure Descriptions

Whilst all information supplied on the website and in our brochure is believed to be correct and to the best of our knowledge, it is understood that the information supplied is for guidance purposes only and does not form part of any contract. 

Complaints or Dissatisfaction

Things do occasionally go wrong, and we promise you we will make our best efforts to rectify faults to your satisfaction. Please inform our local management company quickly to allow them to get the problem rectified as soon as possible. If you are not satisfied with the solution please let us know in writing (or email). We will not accept liability for any dissatisfaction or other complaints not reported to our local manager during your stay.

Force Majeure

Unfortunately we cannot be held responsible nor accept any liability where we are prevented from fulfilling our contractual obligations by "force majeure". These include but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes and other industrial disputes, natural disaster, fire, acts of God, terrorist activities, technical difficulties with transportation and utilities, closure of ports or ferries, quarantine, epidemics, weather conditions, government action or other events outside our control. Your travel insurance may cover you in some of these events.

Governing Law

This agreement shall be construed in accordance with and governed by the law of England and Wales and each party agrees to submit to the non-exclusive jurisdiction of the courts of England and Wales.

Please Note that the services we aim to offer are available as far as we able to provide them and that we cannot be held responsible if a service supplied by a 3rd party is unavailable despite our best efforts to provide it.

Booking Confirmation

Booking is confirmed once initial deposit has been received and accepted.
